Unfair Competition

Costa Rican laws contain a series of provisions granting protection against unfair, illegal trade practices, especially Law No. 7472, "Law of Promotion of Free Competition and Effective Defense of Consumers", and the Criminal Code.

Lawsuits are the only recourse against this kind of practices, except in cases when an act of unfair competition has direct effects on the consumer ; in this case, an administrative action can be taken before the National Consumer Commission.

As for unfair competition acts related to Intellectual Property, our country has subscribed several instruments that offer protection against unfair practices, such as the Central American Industrial Property Agreement and the Paris Industrial Property Protection Agreement, among others.
